Ole Sendeka’s case takes new turn
By Musa Juma
Member of Parliament for Simanjiro, Christopher Ole Sendeka is now facing a new
charge of threatening the Arusha Regional UVCCM Chairman James Ole Millya with
his handgun.
Ole Sendeka was previously arraigned at the Arusha Resident Magistrate’s Court
charged with assaulting the same person. Public Prosecutor Michael Luena claimed
in court that the MP had assaulted Millya with fists on January 9 this year in
Monduli.
The prosecutor claimed, in the amended charge sheet that on that day at a
seminar recess in Monduli, the MP attacked Millya, beat him up and threatened
him with a firearm contrary to Section 2a Cap 89 of the Penal Code.
It was claimed before Magistrate James Karayemeha, that Ole Sendeka did attack
the complainant while attending a seminar organized by the Monduli MP Edward
Lowassa in collaboration with an NGO called KIDO.
After the allegations were heard Sendeka pleaded not guilty to all the charges
through his lawyer Michael Ngalo of Arusha.
The prosecution side intends to call 13 witnesses and has presented in court
three exhibits: Police Form Number 3 (PF3), a hospital treatment chit for the
complainant and Sendeka’s pistol to support their case.
The case comes up for hearing on May 27 while Sendeka remains out of bail.
Police nab 11
twilight girls
By Happy Lazaro
Police in Arusha on April 18 arrested 11 so-called twilight girls. They were
arrested at around 1 am at a popular night spot known as Shivas in Kaloleni area
and around the Clock Tower on Boma Road.
According to the Arusha’s Regional Police Commander Basilio Matei, police set up
a trap to net the suspects after numerous complaints from members of the public
who had fallen victims of the girls.
The girls are alleged to have been invading motorists who park at Shivas Club
and Clock Tower areas and propositioning them for paid sex.
In some occasions the girls have been reported to approach innocent men and
scream ‘rape’ to force the victim to pay in order to avoid public embarrassment.
Some police officers in civilian cars were deployed to the area on the night of
arrest to wait for the twilight girls famous for their predator smiles.
The arrested girls were expected to be arraigned in court for loitering. The
girls range from 20 to 29 years old and are from Sombetini, Ngarenaro, Esso,
Unga Limited, Ngulelo, Mbauda and Sanawari.
The RPC said police would go on with their “sweep” operation to remove the
undesirable elements from the Arusha urban area.

A
fresh probe has been launched to investigate the case of three cows that were
shot dead near Mkomazi Game Reserve in Same District of Kilimanjaro two months
ago.
The
new investigations recently ordered by the Kilimanjaro Regional Police
Commander, Lucas Ng’hoboko follows a court proposal filed by the cattle owner
Roine Megirori under miscellaneous criminal application at the Same District
Court in Mwanga this month, where the latter demanded that he opens private
prosecution having ‘lost trust’ with the local police.
Roine Megirori a livestock keeper residing in
Kisiwani location of Same District, claims to have lost 30 cattle on the
29th of January this year when wardens from Mkomazi Game Reserve
intercepted livestock that were grazing near the park, shot three, dispersing
the remaining 27 which remain lost to date.
Megirori is filing a private suit against the
Mkomazi Warden, Miradji Ibrahim Mramba accusing the latter of killing, or
ordering the shooting of three of his livestock and causing the loss of 27
others during the shooting fracas which reportedly occurred at Oligandu area
near Mkomazi Game Reserve.
“When the three cows were gunned down, the bangs
and loud shots scared my cattle and the animals ran helter-skelter into
wilderness never to be seen again,” said Megirori who claimed that his cattle
were a long distance away from the game reserve so he wonders why the wardens
from Mkomazi, who were riding in an open truck decided to fire at them.
Migori is being assisted by Lekei Ole Milakon
from the non-government organization known as Nareeto based in Same District.
Speaking at his Mwanga office, the Same District
Court Magistrate, Salum O. Msigiti admitted that Megirori did file a private
prosecution against the respondent on March 30 this year
but they were waiting for Miradji to respond by counter-affidavit that need to
be submitted to the court within two weeks.
Magistrate Msigiti explained that the Private
Prosecution was filed after the complainant claimed that he would carry-on with
the case without involving the local police with whom he had lost confidence.
Farmer Roine Megiori had filed a
Police Case after which he got issued with file-case number, MWG/R/ 142/2009
which he expected that it will be taken to court but after the police failed to
open a case against the Mkomazi officer, the cattle keeper decided to go about
it on his own.
The Police in Same District when contacted
claimed that the case file was not taken to court because it had been forwarded
to the Regional Police headquarters in Moshi and they were waiting for a
response from there.
Speaking in his office at Moshi, the Kilimanjaro
Regional Police Commander, Lucas Ng’hoboko at first thought maybe the police in
Same District were still conducting investigations but when he contacted the
Regional Crime Officer it became apparent that the case file hadn’t yet been
brought to Moshi as claimed.
The Kilimanjaro Police has now ordered the
Regional Crime Office to supervise a fresh probe onto the cattle shooting
incident of Mkomazi and compile another report. He also advised the cattle owner
to file fresh statement regarding the issue to help them follow up the case.
