New book launched in Lawyers' forum

Pitfalls in Litigation, a law book written by one of Tanzania's prominent
lawyers, the late Ben Nicholas Lobulu was officially launched last weekend
before an audience of about 200 lawyers, including representatives from Kenya
and Uganda.
The inauguration of the 275-page book held last weekend at Ngurdoto Lodge, 24
kilometres east of Arusha was graced by the President of the Tanganyika Law
Society, Mr. Kibuta Ongwamuhana who officiated the occasion on behalf of former
Prime Minister, Mr. Justice Jospeh Sinde Warioba.

The book was written just before the author's death in August
2000 and was printed last year with support from Survival International, an
organization based in London, which works for the rights of marginalised tribes.
The author was the advisor of Survival International in their campaign for
pastoralists in Tanzania.
The book divided into 14 Chapters is a detailed presentation
of the difficulties encountered in the way the High Court and the Court of
Appeal exercise their wisdom or innovation in interpreting the Rules of
Procedure.
The problems are elaborated by examining about 130 civil cases that have been
contested in the Higher Judiciary mainly in the 1990s.
The book whose foreword was written by the Honourable Warioba is of great use to
practising lawyers. The book is also an important reference book for law
students regarding the mandatory subject of Legal Method.
"Pitfalls in Litigation" is a lively book in that it takes us to the limits to
which rules of court can be interpreted to attain ends in justices, noted
Justice Warioba.
Ben Lobulu attained his Bachelor of Laws degree from the
University of Dar es Salaam in 1973 and Master of Arts degree in Business Law
from the University of London in 1978.
He worked as a Counsel for Tanzania Legal Corporation for
eight years before joining the Tanganyika Development Finance Limited where he
served as Company Secretary for four years. He was appointed by the President in
1993 to serve as Commissioner for the National Electoral Commission, a position
he held until his death in 2000.
Ben Lobulu has published many papers on the Rule of Law,
Democratic Process and Human Rights. He has published another book entitled
"Citizens Rights in Tanzania, 1995", which is a collection of writings on Human
Rights and Democracy in Tanzania.
The book's launch was held during the Tanganyika Law Society
Annual General Meeting on February 12. The meeting was preceded by a continued
legal education seminar with presentations by prominent lawyers from East
Africa.
The theme of the seminar was Integrating the Practice of Law in East Africa.
