MP files bill of costsby Valentine Marc Nkwame
With only 24 months left before the next General Elections, the Member of Parliament (MP) for the Arusha constituency, Felix Christopher Mrema, has filed claims against Estomih Jonas Mallah, his opponent in the previous General Elections. Mrema who contested for the Parliamentary seat as a candidate of the ruling "Chama Cha Mapinduzi" (CCM) beat Mallah in the 2000 General elections, emerging the overall winner with 32,289 votes. Mallah who scored second with 24,384 filed a lawsuit, opposing the results on grounds that there had been some foul plays in the voting exercises, in which four candidates took part. Mallah, who was a candidate of the Tanzania Labour Party (TLP) filed the case in November 2000, only to drop it one year later, claiming it was too costly. This time however, the tables have turned and the shoe is on the other foot. Mallah is now a defendant with regard to the same election petition of 2000. Felix Mrema, through his advocate, Eric S. Ng’maryo is claiming Tsh.11,311,700 as compensation for the expenditures incurred throughout the period of the proceedings. The Bill of Costs number 27 of 2002, served to the Judgement debtor: Estomih Mallah presents the total cost of the Tsh.11.3 million in two sub total claims of Tsh.10,977,200 and Disbursements of Tsh.334,500 respectively, both covering court appearances, transport costs, stationery charges and fees for filing replies to amended petition, memorandum of Review and Drawing the Decree holder’s reply to the amended petition. The case, which was to be read last Monday, the 25th of August 2003, has however been carried forward to the 18th of September 2003. |
